Commissioned Goods

Payment

  1. Prices are in Sterling and are exclusive of VAT, freight, duties and tax unless otherwise stated. Any quotation is valid for a period of 30 days only from its date, provided that it has not been previously withdrawn by Ellison Art Glass.
  2. For commissioned goods a 50% deposit is required on all orders before we commence any works. Once a deposit has been received this will act as confirmation of the initial order and will signal an acceptance of these terms and conditions. All of our commissioned goods are handmade and bespoke and as such all orders and sales are final. It is the policy of Ellison Art Glass that no commissioned goods may be returned and no refunds will be made unless due to faulty workmanship or damaged goods. The goods will remain the property of Ellison Art Glass and ownership will not pass to the customer until full payment is made, including delivery costs if applicable.
  3. The full balance is to be paid on completion and collection or prior to delivery arrangements. Payment may be made by bank transfer (BACS) or cheques are accepted but 10 working days must be allowed for clearance. To pay a deposit please make payment by bank transfer to Santander account: 22727329 sort code: 09-01-27 or cheque payable to "Ellison Art Glass Limited". Please remember to quote your customer reference number. Ellison Art Glass reserves the right to charge interest on overdue invoices which shall accrue from the date when payment becomes due from day to day until the date of payment at a rate of 3% over Santander Bank plc base rate, such interest to be charged on a monthly basis and compounded.

Collection and Delivery

  1. We recommend that all finished goods are collected by or arranged to be collected with relevant insurance cover by the customer. Completed work being collected must be inspected and documentation indicating the goods are in good condition must be signed at the time of collection. Any claim for faulty or damaged goods must be made immediately on collection. Ellison Art Glass accept no responsibility for any breakage or damages incurred in transit while using the customer's own shippers.
  2. If requested, deliveries can be arranged with a third party courier service. Transportation and packing costs will be added to the final invoice. The customer should inspect the goods immediately upon delivery and before signing the courier's paperwork. Goods should not be signed for "unchecked". If any goods are delivered damaged, please make a note of the damaged item on the delivery paperwork, photograph the damaged item and packaging and contact us immediately with the details. We will not be liable for any claims in respect of defects which should reasonably have been discovered by the customer on inspection or after a signature has been obtained. If on delivery the customer is not available to accept goods on an arranged date or refuses delivery to any undamaged goods they will be charged for the return of the goods to us. Ellison Art Glass accept no responsibility for any breakage or damage that may occur while the goods are in transit with a third party courier service.
  3. All goods unloaded at the final destination are at the customer's own risk. It is the customer's responsibility to ensure that facilities are available for receiving the goods at their final destination. Please note any time or date for delivery stated by Ellison Art Glass shall be treated as an estimate only. Ellison Art Glass cannot accept liability by the courier's failure to deliver within any specific time period and we cannot accept responsibility for delivery delays due to adverse weather conditions or abnormal traffic restrictions.

Inspection of Goods

  1. All goods produced by Ellison Art Glass are handmade and therefore no two pieces can be exactly alike. We specialize exclusively in the hand decoration of glass and mirror, including brilliant cutting and bevelling, and it is in the nature of all handmade products for "touch marks" from the crafting of hand tools used and a variation in colour and shape to occasionally occur. It is also in the nature of glass or mirror to have slight imperfections, for example hairline scratches or small air bubbles. All glass and mirror supplied by Ellison Art Glass is in accordance with current Glass and Glazing Federation guidelines, which state that any marks, blemishes and surface scratches not visible on the glass or mirror when viewed in a vertical position at a distance of one metre in a natural light environment are not considered detrimental to the product and do not render the product faulty.

Safety and Regulations

  1. All glass and mirror is supplied on the understanding that the customer has knowledge of and will use the glass and mirror in accordance with all relevant British Safety Standards or local building and safety codes for non UK installations. Some internal and external areas of glass installation are considered 'critical locations' for safety reasons. This term is usually (but not exclusively) applied to doors, side panels, windows and partitions in certain areas, and where glass is used in these applications they must comply with the relevant British Safety Standards. It is the customer's responsibility to seek standards or local building and safety codes for non UK installations. Brilliant cut goods provided for these locations will be supplied on laminated glass. Toughened (also known as tempered) glass cannot be brilliant cut, nor can brilliant cut glass be later toughened. If toughened glass is specified, any decoration will be limited to gilding, silvering, sandblasting and painted effects.

Toughened or Tempered Glass

  1. On close inspection toughened (tempered) glass will have slight ripples, imperfections and surface scratches and will be more apparent when the panels are mirrored than on clear glass. This is caused by the processing, heating and cooling of the glass and is an unavoidable factor of toughened glass and shall not be classed as a defect, therefore the customer must be fully aware when specifying this process. Imperfections that are not clearly visible in a 500mm square when viewed in a vertical position at a distance of two meters in a natural light environment are deemed acceptable. Please note for aesthetic reasons all toughened goods Ellison Art Glass supply will exclude BS Kitemarks unless otherwise requested by the customer.

Site Surveys and Installations

  1. Ellison Art Glass focus solely on the hand crafting and supply of decorated glass and mirror and do not offer site surveys, templating or installation of finished goods into the final location.
  2. It is the customer's responsibility to seek professional advice from a qualified source prior to ordering to ensure that the goods are fit for purpose and to ensure that issues such as access, size, weight, properties, hanging and fitting are suitable. Any advice on thickness or size of glass or mirror and method of installation provided by Ellison Art Glass does not guarantee adequacy for a specific purpose and is given on the basis that the product specification is to be checked for suitability by the customer. Ellison Art Glass accept no responsibility at all in respect of whether the customer's walls are suitable or the products application is appropriate for it's intended use and cannot accept any liability for damage or injury to property or persons or for any costs, expenses or losses incurred by the customer as a result thereof. We strongly advise that the customer does not schedule any installation work until full receipt of the goods.
  3. We can arrange site surveys and installation through a third party company on request.

Installation Environments

  1. If glass and mirror is installed in a damp or humid environment it may suffer damage caused by moisture and as such Ellison Art Glass cannot be held liable. Goods other than glass and mirror, for example frames made from natural woods and metal, may react to atmospheric conditions such as humidity or dryness caused by air conditioning, under-floor heating, etc. Ellison Art Glass cannot be held responsible for changes in these materials resulting from temperature changes.

Templates

  1. Please provide all templates to full actual size required. Templates should be made of either plywood, hardboard or MDF. Please label face surface (the side the glass or mirror is to be viewed from) with customer's name, any reference information and whether the template needs to be returned with the order.

Tolerances

  1. All glass when processed has an industry standard manufacturing tolerance. 4mm and 6mm glass has a manufacturing tolerance of +/- 2mm. In some instances tighter tolerances may be possible, please inform us before work commences if tighter tolerances are required.

Samples

  1. Samples demonstrating our various techniques and finishes can be loaned for up to 3 weeks. As they are individually made and expensive to produce we would need to charge if loaned samples are lost or returned damaged. For a bespoke sample we would usually make a small charge that would be deducted from the final cost when an order is confirmed.
  2. As all of our samples are handmade, it is in their nature that they are unique and variation between panels will occur... whilst we endeavour to match to samples as closely as possible, we cannot guarantee an identical match and any samples provided should be used as an indication of finish only. There will also be more variation between a small sample and larger panels of glass. We will always work to match a sample as closely as possible until we are satisfied the match is as close as it can be.

Organic Ageing

  1. It is the nature of mirrored glass to organically age over time and as such Ellison Art Glass is not liable for any undesirable organic ageing after installation.

Care Instruction

  1. All glass and mirror products should be cleaned with a soft, dry cloth. Never use cleaners with alcohols or solvents.

Warranty

  1. Ellison Art Glass warrants that it will for a period of 12 months from the date of collection or delivery, repair, replace or provide the customer with a full or partial refund for any goods which are accepted by Ellison Art Glass as being defective or not fit for purpose. We shall either collect the goods on a date agreed between ourselves and the customer or ask the customer to return the goods to us at our cost.
  2. Once we have checked that the goods are faulty or non-conforming, we will either repair the goods, replace the goods or provide the customer with a full or partial refund. If our examination reveals that the goods are not faulty, we may ask the customer to pay for the costs of packaging and returning the goods to the customer. These terms and conditions will apply to any repaired or replacement goods we supply to the customer.
  3. This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by the customer or any third party, any use of the goods in a way that we do not recommend, the customer's failure to follow our care and installation instructions, or any alteration or repair the customer carries out without our prior written approval.

Items For Sale

  1. Prices are in Sterling. Items For Sale prices are as set out on the website inclusive of VAT. Prices quoted may be subject to change without prior notice at the sole discretion of Ellison Art Glass.
  2. All goods purchased from our Items For Sale page are covered by the statutory right to cancel within 14 days, with the exception of bespoke custom items including decorative work and glass and mirror products custom made to size. Any returned goods must be undamaged and of re-saleable quality and will be inspected by us upon receipt before a refund is made. The safe and secure packaging and cost of return delivery of the goods is the responsibility of the customer unless the goods are deemed faulty.
  3. A contract between the customer and Ellison Art Glass for the sale of our products will only exist once an order has been accepted. Once an order is confirmed it is not possible to cancel or amend the order unless agreed with ourselves. Title to goods shall only pass to the customer when payment has been received in full. This does not affect the customer's statutory rights.
  4. Availability of goods is subject to change without notice.

Payment

  1. The price of the goods for sale includes packaging and delivery to Mainland UK. Delivery costs and service outside the UK are available on application. The customer will be liable for all duties and levies payable at any foreign port as a result of delivery of goods outside the UK. The customer shall not be entitled to cancel the order on the basis of unforeseen duties or levies.

If upon delivery the customer is not available to accept goods on an arranged date or refuses delivery to any undamaged goods they will be charged for the return of the goods to us.

  2. Wall mirrors are supplied with an aluminium split batten fixing which is suitable for hanging on flat walls. We recommend employing the services of a professional for safe and secure installation.

Ellison Art Glass accept no responsibility at all in respect of whether the customer's walls are suitable or the products application is appropriate for it's intended use and cannot accept any liability for damage or injury to property or persons or for any costs, expenses or losses incurred by the customer as a result thereof.

General

  1. It is Ellison Art Glass intention that all information on the website should be as accurate and up to date as possible. However, we cannot guarantee the reliability or the accuracy of the information contained within its pages. We reserve the right to change product specification without prior notice.
  2. Due to differences in models of monitors, printers and other viewing devices including individual settings on your computer we cannot guarantee that colours on images on our website are the exact and final colour of the item.
  3. The price of any commission will vary depending on several factors, including size, type and thickness of glass, duration of consultation and research, complexity of the design, and fluctuations in the price of materials. All prices are therefore quoted on an individual basis and price comparisons with previous or similar work undertaken by us or other companies should not be assumed by the customer.

Intellectual Property

  1. All artwork supplied by the customer for commissioned work is accepted on the understanding that the customer owns the copyright of any supplied design, photograph or other image, or has sought and had permission granted by the owner of the copyright of the supplied design, photograph or other image.
  2. Where Ellison Art Glass carries out design work as part of the production of bespoke goods, we retain all copyright, design rights, patents and other intellectual property rights that we create or author. Aside from the right to use the bespoke goods, the customer will not obtain any right, licence or other interest in our intellectual property. We may go on to supply bespoke goods ordered by the customer to any third parties.
  3. Ellison Art Glass have the right to photograph all designs that we manufacture and use any images for promotional purposes unless requested in writing by the customer not to do so. Ellison Art Glass will respect the customer's confidentiality by not revealing the customer's details or project name.

Force Majeure

  1. In the event that Ellison Art Glass is prevented from carrying out it's obligations as a result of any cause beyond it's control such as, but not limited to: Acts of God, war, strikes, accidents, lock-outs, flood, fire, breakdown of plant, failure of third parties to deliver goods or other such causes, Ellison Art Glass shall be relieved of its obligations and liabilities for as long as such fulfilment is prevented.

These conditions and any contract between Ellison Art Glass and the customer shall be governed by the laws of England and the customer agrees to submit to the exclusive jurisdiction of the English Courts.
